Facts: Client received a complaint from BON alleging that she allowed a nursing student to administer a controlled substance to a patient without supervision. Further, the complaint alleged that she also allowed the student to have unsupervised access to the patient’s records and charts.

Outcome: Firm provided a response to the complaint and argued that client was under the impression that the student was allowed to administer all medications except through intravenous measures. Evidence was provided to indicate that was correct. However, the student was still required to be supervised. The firm then provided argument in mitigation of client’s error and in support of her professional character. Based on the argument and evidence provided BON offered client an order merely requiring completion of continuing education. BON did not place any direct supervision requirements on client’s license nor suspend her ability to practice.
