As a medical professional, you dedicated years of your life training to help people in need. You spent many more years building a solid reputation for being excellent at your job. If a complaint is filed against you with the Texas Medical Board, all that you have worked for is put in jeopardy.
Who May File A Complaint with the Texas Medical Board?
A complaint may be filed with the Texas Medical Board (TMB) by virtually anyone.
TMB complaints against a licensed provider may be filed by a:
- Patient
- Colleague or boss
- Another health care provider
- An insurance company
- State agency or another regulatory body
- Law enforcement
- Other sources
The ability to file a complaint is not limited solely to patients. A disgruntled family member of a patient even has the ability to file a complaint against any practitioner licensed by the TMB.
Does the TMB Investigate All Complaints?
Yes, the TMB receives over 7,000 complaints every year and it investigates every one of them. The Board investigates complaints against physicians, physician assistants, acupuncturists, surgical assistants, respiratory care practitioners, medical radiologic technologists, medical physicists, and perfusionists.
The Board requires that a complaints be in writing, include the full name and practice address of the licensee, and provides dates and details of the alleged incident. The TMB first determines whether it has jurisdiction, in that the complaint is against a practitioner the TMB licenses. The Board then reviews the complaint to determine if there is evidence to support an allegation that there has been a violation of the Medical Practices Act.
Should I Hire A Medical License Defense Attorney?
Yes, it is critical that you seek the help of an experienced medical license defense attorney as soon as you are notified by the TMB of a complaint against you.
While not all complaints filed with the TMB are pursued past the preliminary evaluation stage of the enforcement process, any complaint filed against you could put your career in jeopardy. The complaint may be baseless, or there may be extenuating circumstances. Even if you feel the complaint is unfounded, it can tarnish your professional reputation. Whatever the reason is behind a complaint, it’s a critical moment in your professional life and you need to take immediate action.
