LVN 348327 – Warning with Stipulations and Fine

In this case, a Licensed Vocational Nurse (LVN) brought her daughters to work with her and cared for a patient in their presence. On another occasion, she failed to wear personal protection equipment (PPE) while performing in-line trach and oral suctioning on a patient. In other incidents, she was observed vaping while working a shift, asleep with her head resting on a patient’s bed, and falsely documenting the administration of a DuoNeb Inhalation Solution treatment. 

The LVN received a warning with stipulations and a fine. More specifically, the LVN agreed to complete the TBON course “Understanding Board Orders,” complete certain remedial education courses, pay a $250 fine, and work as a nurse providing direct patient care for at least 64 hours per month for one year. In addition, the LVN must provide all employers with a copy of the TBON order and be supervised by an LVN for at least two years on the premises. The employer also must provide quarterly performance reports on the LVN to TBON. 

RN 249524 and LVN 77681 – Warning with Stipulations

While employed as a Substitute Registered Nurse (RN), this individual failed to verify a student’s name when administering Adderall to the student. As a result, the RN administered Adderall to the student rather than the Cephalexin that the student was supposed to be administered. 

The RN received a warning with stipulations. TBON ordered the RN to enroll in and complete the Knowledge, Skills, Training, Assessment, and Research (KSTAR) Program, submit to an individual assessment and complete any recommended remediation. The RN also had to complete a TBON-approved Texas nursing jurisprudence and ethics course.

RN 956326 and LVN 333166 – Warning with Stipulations

In this case, a Registered Nurse (RN) exhibited impaired behavior while on duty, including arriving late, appearing lethargic, providing inadequate responses, and acting strangely. The RN later tested positive for amphetamines, methamphetamine, and marijuana. After a chemical dependency evaluation, a doctor concluded that the RN was not experiencing difficulties with drugs or alcohol and recommended random testing and professional counseling. 

The RN received a warning with stipulations. Those stipulations include completing the TBON course “Understanding Board Orders,” completing certain remedial education courses, and working as a nurse providing direct patient care for at least 64 hours per month for one year. In addition, the RN must provide all employers with a copy of the TBON order and be supervised by an RN with at least two years on the premises. The employer also must provide quarterly performance reports on the RN to TBON. The RN also is subject to random drug screens once weekly for the first three months, twice monthly for the second three months, once monthly for the next six months, and quarterly for the remainder of the probation period. Finally, the RN must undergo professional counseling with periodic reports to be submitted to TBON.

LVN 335172 – Warning with Stipulations 

In 2021, an LVN received a warning and stipulations and was required to complete the Knowledge, Skills, Training, Assessment, and Research (KSTAR) Program for failing to properly document scheduled albuterol treatments for a patient on a ventilator. Shortly after receiving her warning from TBON, the LVN was observed sleeping during her shift.

As a result, the LVN received another warning and stipulations superseding the prior TBON order. Those stipulations include completing the TBON course “Understanding Board Orders,” completing certain remedial education courses, and working as a nurse providing direct patient care for at least 64 hours per month for one year. In addition, the RN must provide all employers with a copy of the TBON order and be supervised by an RN with at least two years on the premises. The employer also must provide quarterly performance reports on the RN to TBON.

LVN 310153 – Warning with Stipulations and Fine

In this case, a Licensed Vocational Nurse (LVN) failed to make a home visit to a patient and falsely documented wound care. The LVN also created or had someone else create false documentation of the visit note. The LVN received a warning with stipulations and a fine.
