Occupational therapists in Texas are licensed and regulated by the Texas Board of Occupational Therapy Examiners, which is a subsidiary organization to the Executive Council of Physical Therapy and Occupational Therapy Examiners. The latter organization is responsible for investigating formal complaints filed against occupational therapists.
The process is as follows: When a complaint is received, the Board selects an investigation staff (usually comprising two people) who will work with an investigation committee to assess the complaint. If the complaint is found to both fall within the jurisdiction of the Board to investigate and to have merit, then a full investigation will commence. At this point, the occupational therapist whose license and livelihood are under fire will be made aware of the complaint. Depending on the case’s complexity, the investigation may take from fewer than 90 days to six months to complete.
The notification of complaint the practitioner receives will request a response to the allegations. This is the first step in the occupational therapist’s defense. If the response to this letter is well-crafted by someone who is familiar with the complaint process before administrative boards, it can aid in containing the scope of the investigation—since these investigations tend to expand what they cover as they proceed when there is not some sort of defensive container to restrict their spread.
