The Texas Board of Nursing (BON) conducts investigations of allegations against nurses and adjudicates complaints. When an investigation is opened against a Texas nurse the BON provides due process to the nurse, giving him or her notice of the investigation and allegations, the opportunity to respond to the alleged conduct and to show compliance with the Nursing Practice Act.
Confidentiality of Complainant
Although the Nurse is given the opportunity to respond to allegations, the name of complainant (the person who lodged the complaint with the BON) will be kept confidential. All complaint information submitted to the Board is kept confidential throughout the entire process of the investigation.
Even if the Board ultimately takes disciplinary action against the nurse, the source of the complaint will remain confidential.
Patient’s Identities are Protected During Investigations
Whether a patient, patient’s family member, or a third party files a complaint against a nurse, the patient’s identity will be protected during the investigation. If and when records of an investigation must be filed publicly, all confidential information is redacted. Efforts are made to protect the identity of patients during the BON’s enforcement process.
The Board is authorized to have access to confidential, protected patient information because of its sanctioned oversight activities.

Certainly not knowing the identity of the complainant can make defending against allegations more challenging―but not impossible.
