The Texas Board of Chiropractic Examiners (TBCE) licenses skilled chiropractors and enforces the standards of chiropractic care in the state of Texas. In its September 2018 Board Report, the TBCE reported a summary of disciplinary actions for dates ranging from March 1, 2018 through August 31, 2018.
During that time period, the Board reports that it received 96 complaints. During the same time period, there were 80 complaints closed – 16 of which were closed with Board Orders. The average number of days to close a complaint is 170 days.
The top three closed complaints by violation type were: lack of due diligence, records allegations, and criminal convictions. There were 13 chiropractic licenses placed on probation and 4 were suspended between March 1, 2018 through August 31, 2018.
- Lack of due diligence: Failure to use proper diligence in the practice of chiropractic or using gross inefficiency in the practice of chiropractic care is grounds for revocation or suspension of a chiropractic license. Occ. Code § 201.502(a)(18), 22 Tex. Admin. Code § 79.2.
- Record allegations: Chiropractors have a duty to maintain proper patient record and documentation and furnish copies of chiropractic records, pursuant to 22 Tex. Admin. Code § 76.2 and 76.1 respectively.
- Criminal Convictions: The Board shall suspend a chiropractor’s license on proof that the chiropractor has been initially convicted of a felony and certain misdemeanors. 22 Tex. Occ. Code § 201.5065.
Given that 96 complaints were received during the above reported time period and 17 licenses were disciplined with probation or suspension, if you receive a complaint against your Texas chiropractic license there is roughly an 18% chance –almost a 1 in 5 chance–that your license will be taken away, at least temporarily.
During the time your license is probated or suspended, you may not practice chiropractic care. It is illegal to practice chiropractic care without a license. This means a single complaint puts your career and livelihood in jeopardy. It is imperative that you take any complaint filed with the Texas Chiropractic Board seriously and address the matter head-on from the start. Even if you feel the complaint is meritless, know that the Board is not on your side and it is up to you to properly defend yourself against accusations.
