As a licensed plumber in Texas, you work hard every day to do your job right. You show up to calls on a moment’s notice to help stop a major leak or unexplained flooding in the basement. Homeowners and businesses rely on you to install plumbing systems correctly. A faulty plumbing system creates a risk of injury, disease, or even death. The quality and dependability of your plumbing work is essential to a safe and clean society.
The Texas State Board of Plumbing Examiners (TSBPE) is the regulatory body of the plumbing trade in Texas. The Board’s mission is to “protect Texas citizens against the health and safety hazards that can result from improperly installed plumbing, gas, and medical gas systems.” The TSBPE is obligated to review every compliant filed with its office. When your professionalism is brought into question by a dissatisfied client, you need to have legal protection from the very first moment to preserve your reputation.
The Complaint Process Against Texas Plumbers
When a complaint is filed with the TSBPE, the Enforcement Department determines if the complaint is within the TSBPE’s jurisdiction. If so, then you will be sent a copy of the complaint and asked to respond in writing. The TSBPE will provide a copy of your written response to the complainant.
Your initial responses to the allegations made against you are your first opportunity to defend your plumbing license. Consulting with a plumbing license defense attorney before providing the Board with your response is the first step to help ensure the most favorable outcome possible in your case.
After your written response to the complaint is received, a Field Representative will be assigned to investigate the complaint and will contact both you and the complainant for an investigation interview. TSBPE Field Representatives enforce Plumbing License Law and Board Rules. They are tasked with investigating consumer complaints, conducting job-site compliance checks, and aiding plumbing inspectors and consumers with enforcement related questions and issues.
Once the investigation is complete, the TSBPE’s Enforcement Committee will review the evidence to determine whether there is sufficient proof of a violation. If the Board finds a violation of Plumbing License Law or Board Rules occurred, it has the power to revoke or suspend a license, place a licensee on probation, or issue a reprimand, administrative penalty, or request voluntary compliance by the licensee to correct the violation.
If someone has become ill or structural damage has occurred allegedly as the result of your work, you don’t want to face such serious charges alone. If there are allegations concerning how you handled plumbing installation or repairs, you want to mount a strong defense to protect your license. You want an experienced professional license defense attorney on your side, advocating for your best interests.
